UNITED STATES,  May 1, 2025 - In a stinging rebuke to the Donald Trump Regime’s  immigration crackdown, a federal court in southern Texas has ruled that President Trump's controversial invocation of the Alien Enemies Act to conduct mass deportations without due process is unlawful. 

U.S. District Judge Fernando Rodriguez, Jr., a Trump appointee, wrote that Trump's invocation of the act "exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute's terms."

The government, he ruled, does not "possess the lawful authority under the AEA, and based on the Proclamation, to detain Venezuelan aliens, transfer them within the United States, or remove them from the country." The men in this Texas case have been threatened with imminent removal under the Alien Enemies Act, according to the American Civil Liberties Union.

They are accused of being members of Tren de Aragua, a Venezuelan gang. They remain in detention at El Valle Detention Center in Raymondville, Texas.

The landmark decision immediately blocks authorities from deporting immigrants currently detained in the Southern District of Texas, effectively severing a pipeline to El Salvador's notorious CECOT prison facility, where reports of torture have drawn international condemnation.

The ruling represents a critical check on what immigration advocates have called an unprecedented expansion of executive power. 

By attempting to deploy the rarely-used Alien Enemies Act—a centuries-old statute originally intended for wartime scenarios—the administration had sought to bypass traditional deportation proceedings and constitutional protections that normally apply to non-citizens within American borders.

"Immigrants are, and always have been, an integral part of our country," noted legal representatives challenging the policy. 

The court's decision reaffirms the fundamental principle that all persons within U.S. jurisdiction, regardless of immigration status, remain protected by constitutional guarantees of due process—a cornerstone of American jurisprudence that the administration's aggressive deportation strategy threatened to undermine.

Despite this significant victory, immigrant rights advocates caution that the battle is far from over. The ruling, while substantial, applies only to the Southern District of Texas, leaving immigrants detained elsewhere potentially vulnerable to similar tactics. 

Legal experts anticipate an immediate appeal from the administration, which has consistently prioritized aggressive immigration enforcement as a signature policy initiative.

The decision comes amid growing tensions over the administration's immigration agenda, which has drawn fierce criticism from human rights organizations, legal scholars, and even members of the president's own party who question both the legality and morality of mass deportations conducted without individual hearings or meaningful judicial review.
